Pre-K Printables Club Membership Terms of Use & Membership License Agreement

The following Terms of Use ("TOU") are entered into by and between you ("Licensee") and Pre-K Printable Fun ("Licensor"). By purchasing and accessing the Pre-K Printables Club Membership from Pre-K Printable Fun, you agree to the terms and conditions outlined in this Agreement.
1. Grant of License
Licensor grants Licensee a non-exclusive, non-transferable license to access and download any of the digital Pre-K Printable Fun resources in our MemberSpace account area at no additional charge. Furthermore, Licensee is granted the privilege to participate in any exclusive events or access resources found on their dedicated Member Dashboard, which are intended strictly for personal and non-commercial use. The license is limited to a single user, within the confines of a single classroom, within a home-based childcare program, or within a home-school setting, not exceeding 40 enrolled students.
2. Permitted Use
Licensee may use the digital products for educational purposes only. This includes printing, displaying, and distributing the materials within the Licensee's classroom, childcare setting, or home-school classroom. Licensees must adhere to the limitations specified in the license agreement, including the maximum number of students, users, or classrooms allowed. Any use beyond the agreed-upon scope is expressly prohibited.

4. Copyright and Ownership
The digital resources and benefits provided through the Pre-K Printables Club Membership remain the intellectual property of Pre-K Printable Fun and are protected by copyright law. Licensee acknowledges and agrees that no ownership or intellectual property rights are transferred to Licensee through the purchase of the Club Membership.
5. Duration and Termination
The Pre-K Printables Club Membership is effective for the duration of the term specified at the time of purchase. Throughout this period, you agree to keep your login credentials confidential and not to share them with others.The license will terminate automatically at the end of the membership period. Licensee's rights under this license will terminate immediately without notice if Licensee fails to comply with any term of this Agreement.
Customers who have purchased founding Member Plans indicated as VIP or "Lifetime Access" have access to the account area, as long as the account area exists and no less than 120 days. In the event Pre-K Printable Fun intends to close the account area, it shall provide you with a 30-day notice and the ability to download the resources contained in the account area, which is what is referred to as "Lifetime Access" in all marketing content.
Upon termination their Membership License, the Licensee is permitted to retain the printed resources, and digital files they have downloaded, provide they continue to follow terms of use set forth in the Digital Product Licensing Agreement.
6. Refund Policy
Due to the nature of the Pre-K Printables Club Membership and the immediate access to digital resources, all sales are final. Pre-K Printable Fun does not offer refunds for Club Membership purchases.
7. Membership Termination or Suspension
Pre-K Printable Fun reserves the right to terminate or suspend memberships at our discretion. This action may be taken if a member violates the terms of the membership agreement, engages in prohibited activities, or for any other reason deemed necessary by Pre-K Printable Fun. Termination or suspension may occur without prior notice, and the decision of Pre-K Printable Fun is final. If a membership is terminated or suspended, the member will no longer have access to the benefits and resources associated with the membership. No refunds or compensation will be provided in the case of termination or suspension. Members are expected to adhere to the terms and conditions outlined in the membership agreement to maintain active and uninterrupted access to Pre-K Printable Fun's offerings.
8. Modification of Terms
Pre-K Printable Fun reserves the right to update or change these terms of use at any time without prior notice. It is the responsibility of the user to review the terms regularly to stay informed of any modifications. Continued use of the website or services after any changes to the terms constitutes acceptance of those changes. If you do not agree with the updated terms, you must discontinue using the website and any associated services.
9. Governing Law
This Agreement is governed by and construed in accordance with the laws of Washington state. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Clark County, WA.

- Share, distribute, or resell the digital or assembled products to other individuals, classrooms, or entities. This includes but is not limited to uploading the resources to public forums, social media platforms, file-sharing sites, or any other online or virtual space accessible to others.
- Without explicit permission, share or use the resources in any recorded session, Virtual/LIVE teaching session on any online learning platforms including, but not limited to, Outschool.
- Modify, alter, or create derivative works from the digital products.
- Remove or alter any copyright, trademark, or other proprietary notices from the digital products.
- Use the digital products for commercial purposes, including but not limited to selling printed materials, lesson plans, or any other derivative works.
