Digital Product Terms of Use & License Agreement - Pre-K Printable Fun

These following Terms of Use ("TOS") are entered into by and between you ("Licensee") and Pre-K Printable Fun ("Licensor"). By purchasing and downloading digital products from Pre-K Printable Fun, you agree to the terms and conditions outlined in this Agreement.
1. Grant of License
Licensor grants Licensee a non-exclusive, non-transferable license to use the digital products purchased from Pre-K Printable Fun for personal, non-commercial use only. The license is limited to a single user, within the confines of a single classroom, within a home-based childcare program, or within a home-school setting.
2. Permitted Use
Licensee may use the digital products for educational purposes only. This includes printing, displaying, and distributing the materials within the Licensee's classroom, childcare setting, or home-school classroom. Any use beyond the agreed-upon scope is expressly prohibited. Classroom aides or assistants may use the materials only in support of the licensed educator’s classroom. Aides may not copy, store, or use the materials independently or in any other classroom.

4. Copyright and Ownership
The digital products remain the intellectual property of Pre-K Printable Fun and are protected by copyright law. Licensee acknowledges and agrees that no ownership or intellectual property rights are transferred to Licensee through the purchase of digital products.
5. Updates and Revisions
Licensor may provide updates or revisions to the digital products. Licensee is encouraged to download and use the latest version of the products. However, Licensor is not obligated to provide updates or revisions. Access to download links is not guaranteed indefinitely. Licensee is responsible for downloading and securely saving the files at the time of purchase.
6. Termination
This license is effective until terminated by either party. Licensee's rights under this license will terminate automatically without notice if Licensee fails to comply with any term of this Agreement. Upon termination, Licensee must cease all use of the digital products, delete all copies, and understand that no refund will be provided. Pre-K Printable Fun reserves the right to pursue damages or legal action in cases of willful copyright infringement or unauthorized distribution.
7. Refund Policy
Due to the nature of digital products, all sales are final. Pre-K Printable Fun does not offer refunds for digital product purchases.
8. Modification of Terms
Pre-K Printable Fun reserves the right to update or change these terms of use at any time without prior notice. It is the responsibility of the user to review the terms regularly to stay informed of any modifications. Continued use of the digital products after any changes to the terms constitutes acceptance of those changes. If you do not agree with the updated terms, you must discontinue using the digital products.
9. Governing Law
This Agreement is governed by and construed in accordance with the laws of Washington state. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Clark County, WA.

- Upload, store, or share the digital files in shared school drives, Google Drive folders, team drives, or any platform where others may access them.
- Without explicit permission, share or use the resources in virtual classrooms or online learning platforms including Outschool.
- Licensee may cut, assemble, laminate, or arrange the materials as part of normal classroom use. Licensee may not digitally modify, recreate, or create new products based on these materials.
- Remove or alter any copyright, trademark, or other proprietary notices from the digital products.
- Use the digital products for commercial purposes, including but not limited to selling printed materials, lesson plans, or any other derivative works.
